October 3, 2003, Dear Prudence
U.S. District Judge Lonnie Brinkema ignored requests of both the defense and prosecution, and allowed the continuation of the trial of alleged "20th hijacker" French national Zaccarias Moussaoui, though she took the Government's demand for the death penalty and allegations tying Moussaoui to the 9-11 hijackings off the table. (For those mavens who want to read Judge Brinkema's decision, click away.)
As we watch members of the press (who, to be fair, don't techically have "life-time tenure") cower before the power of The Power and give The Power a pass on almost everything, given that they know their careers are tied to one of the 4 or 5 remaining media outlets (you wondered what media consolidation would wrought, didn't you?), its nice to see members of the third branch of government continue to show some levels of independence.
Moussaoui was meant to be a show-trial. This guy is central casting's poster child for why the previous pussy-footed restrictions on law enforcement prevented the seizing of Moussaoui's computer, which would have, magically, yielded enough information to stave off the 9-11 attacks. Except, of course, for the slight problem of... little if any of this is true.
Moussaoui (defending himself, though with court-appointed legal advisors) has asked for the opportunity to defend himself against the most serious charges by interviewing high-ranking Al Qaeda officials in American custody (somewhere). The Government has stonewalled this at every turn, arguing "national security".
It was thought that Brinkema might just dismiss the entire case, paving the way for the Government to bury Mr. Moussaoui as an "unlawful combatant", at least until such time as the next President who respects our Constitution is elected, and countermands the unconstitutional "unlawful combatant" status bullshit. But instead, she is showing herself to be a jurist of courage and absolute integrity-- not tolerating the shenanigans of prosecutor or defendant.
She is allowing both sides to hang themselves; since Moussaoui will not be allowed to defend himself against the 9-11 tie-in charges, he will not have to face those charges, nor a possible death sentence. If, after a fair trial in open court, Mr. Moussaoui is convicted, he will be sentenced to a civilian prison for a defined term, rather than to a military gulag for who knows how long; if he is acquitted, it will be extremely politically hazardous for the Government to then say "but he's guilty anyway" and throw him in the brig (rather than... deport Moussaoui-- to France-- making him Chirac's problem!) But that's where Judge Brinkema has put the parties-- a very prudent, Solomonic outcome (if not upset by an appellate court, of course).
As we of the blogosphere (myself included) pontificate and overreact to the possible abuses of our liberty, it makes me feel a whole lot better knowing that there are still judges out there who take their duties under our Constitution and the rule of law seriously.
