The Unseen Editor writes in with this happy story (for the moment) about the United States Court of Appeals for the Second Circuit right here in New York City reversing Judge Mukasey's decision that "dirty bomber" suspect and United States citizen Jose Padilla could be held as an "enemy combatant" under the in camera circumstances under which he is now held.

The decision was 2-1, and I have no information on it, though more will come.
The options are a so-called "en banc" review by all of the active judges of the Second Circuit, or, to save the formality since this baby is going up anyway, a direct and immediate appeal to the United States Supreme Court.

For most purposes, the capturing of Saddam is no longer of much relevance. This is a good day for the people of the United States.

UPDATE: The Circuit Court ordered Padilla charged with a crime or released within 30 days. We can assume that various stays will be requested while the matter is taken up with either an en banc and/or Supreme Court review. What we can hope from here on in is that the magic of uttering the phrase "9-11" is no longer going to trump the law (or of course, the damned constitution) in the eyes of the the courts, particularly as a panel that sits around 400 yards from Ground Zero just took this courageous action.

Even though 9-11 has changed things you still have to, at some point charge some one with a crime or release them.
