April 20, 2004, The Law in its Majesty

On a personal note, as some of you know, I was up for a public sector position, and am pleased to report that I was offered, and accepted, that position today. Accordingly, for semi-obvious reasons, I have changed my bio data under the rottweiler on the left there (thanks much to Kathy K. for the assist). I will be working for a government official (who I had the privilege of meeting yesterday, and has, I believe, been named exactly once during the course of this blog). I leave it to you to guess who if you don't know... as if it matters...

Which takes to the other big law-related news today, the Supreme Court hearing a very limited question about whether federal courts even have jurisdiction to hear complaints from extra-constitutional prisoners held in the American gulag in the part of Cuba that has no laws (funny that).

Next week, it hears the "unlawful combatant" cases. These are all critical cases-- because at least three Neanderthal justices who should probably be taken out and flogged because of their perennial derogation of the Constitution-- and they know who they are-- already want to toss out the Constitution and say "we'll trust ANY government that WE (as in Scalia, Rehnquist and Thomas, literally) elected to treat prisoners as they see fit.

Let the Court do its best... hopefully, O'Connor and Kennedy LIKE the Constitution this month... Please God, they really are the only thing between us and an unchecked police state (and YES-- its that bad.)

Sorry to go off topic, but I'm interested in your thoughts about the rumors of reinstating the draft in 2005. There was a post on Yahoo yesterday about it and a clip on CNN last night. I don't come here as often as I'd like, so maybe you've already addressed it. I am, however, interested in your take on it.

We will not have a draft in 2005. Its just not going to happen. If Kerry is elected (the slight long shot), he will rapidly draw us down in Iraq, and hopefully, set about re-building our devastated reserve system. Iraq is not his baby (even if he voted for it), and he will ask the military men for the best plan to... draw down. We may literally have to turn to Iran and Syria to help with it-- but then, Kerry (unlike Chimpy) has no plans to invade them.

If, however, Chimpy is reelected (the slight favorite), our military is pretty much finished-- no one will sign up for reserve duty, anyone who can retire from active duty will-- but he will exploit the shit out of who he has until the Iraq thing is cooled down (which will be in 2005).
The political price of a draft is too high-- the Chimp would MUCH rather humiliate the nation and expose it to untold dangers than admit that he is or ever was wrong, or commit political suicide by a draft to replenish our forces (there's JEB's future to think of, for God's sake).

Priorities, people!!!

As for the draft, I don't see the need--as we all know, "Reagan proved that deficits don't matter," so why don't they just increase the pay scale and attract more volunteers? What's another few trillion added to the deficit?
