In a triumph of I don't know what, the United States Supreme Court has agreed to hear appeals arising out of the detention of over 600 men at Camp X-Ray, Guantanimo Bay, Cuba. While the government has argued about the urgent national security need to make up the rules as it goes along, others disagree, and find it ominous that the government is holding people beyond the purported reach of any American court's ability to find such detentions unlawful. The Supreme Court had previously ducked other post 9-11 detention related cases, so this is a bit of a surprise. Lower courts had more or less sided with the government's position so far.

I'm disappointed that so many who would decry abuses of government power if a Democrat were in the White House are content to silently acquiesce in a pretty radical erosion of "the rule of law", done, naturally, in the name of "national security", simply because the perpetrator is a Republican. I'd just like to see what intellectual giants like Rush Limbaugh and Newt Gingrich would have to say if it were Bill Clinton that had proposed military tribunals that might include American citizens that might include detention even after acquittals. That habeas corpus could be suspended without so much as a Congressional resolution doing it. That citizens can be locked up, in camera, indefinitely, without charge or trial or even counsel.

We'll see. Its up to the Supreme Court to decide if it wants to take the rule of law back into the courts, or if it likes arbitrary authority exercised by the man it selected (or to be fair at least, greatly assisted) to be the President. Here's hoping that the High Court took this case for a reason.
